Forcefully assigned census duty

In Delhi govt schools, there are so many guest teachers(temporary) on daily wages. There contract tenure remain valid till the start of summer vacation i.e. 10 may every year. After that their contract renewed from 1 july. From 11 may to 30 june they don't get any payment as wages. They are not part of department within this period Now they are listed for census duty which is going to start from 16 may. As these guest teachers have no contract with government from 11 may how government can forcefully bound them to another work without paying salary from the department.

This work will be of 30 days from 16 may 2026 to 15 June 2026.Census department is giving honorarium of Rs. 9000 for the said task. I.e. 300 Rs. Per day.A labor gets 500-700 Rs. Per day as per labor department norms but a teacher will get only 300 Rs per day as honorarium no salary. How can a temporary teacher survive in the city with 9000 for a month and bound forcefully to perform census duty?

What can be done in this matter at expert level here as it is a high level of exploitation by the government.

It has also come to the notice that in a district, guest teachers who have given representation for exemption of duty whatsoever may be the reasons i.e. medical ground are recommended the director education to stop pr terminate the service by DM

RTI route — तीन अलग authorities से information माँगिए: - Director of Education, GNCTD — से (a) policy/circular जिसके तहत non-contract guest teachers को census duty के लिए mandate किया जा रहा है, (b) ₹300/day honorarium का basis vs Minimum Wages Act rates, (c) medical-ground exemption requests पर termination recommend करने का authority - Census Operations Directorate (RGI), MHA — honorarium criteria + non-employees को duty assign करने की legal authority - Labour Commissioner, GNCTD — current Minimum Wages notification (Delhi में 2026 के लिए unskilled = ₹571/day, semi-skilled higher)

सारथि जी, मैं भी Lucknow में government teacher union से जुड़ा हुआ हूँ — यहाँ भी exactly यही pattern है। Director of Education को centralized RTI भेजिए, और parallel में Census office RGI को MHA-level RTI। दोनों में 30 दिन में जवाब न आए तो जल्दी First Appeal कीजिए, इसमें time waste नहीं करना।

Important point — Census duty is technically under Census Act 1948, lekin honorarium decision Minimum Wages Act ke saath conflict me hai. Both can be challenged together. Delhi High Court ne 2019 mein similar matter mein observation diya tha ki 'duty assignment cannot override basic wage protection'.

Group together — solo grievance ignore ho jaati hai but if 50+ guest teachers sign one consolidated RTI + representation, weight badh jata hai. हमारे यहाँ same issue पर 80 लोगों ने मिलकर file किया था, response 18 दिन में आया था।
