I want to file an RTI application to get the commercial information of a company that has been awarded a government contract. I don't want the PIO to deny the information citing section 8(1)(d) of the RTI Act. How can I frame my application to get the required information?

Best solution

You can frame your application in a way that you are seeking information about the contract and not the commercial secrets of the company. For example, you can ask for the terms and conditions of the contract, the amount of the contract, etc.

You can also try to get the information under section 10 of the RTI Act, which allows for severability of information. If the PIO can separate the commercial secrets from the rest, they may be able to provide you with the required information.

You should file the application under the company's name, not under the government department that awarded the contract.

Section 8(1)(d) is meant to protect the commercial secrets of companies. If you are seeking commercial information, it's likely to be denied.
