PIO refused to provide information on IAY legacy data
I filed an RTI application to obtain information on the IAY legacy data, but the PIO refused to provide the information, stating that it is not available. I believe that the PIO is hiding information and I want to know what I can do next.

3 repliesYou can file a first appeal with the Appellate Authority, citing §19(1) of the RTI Act. You can argue that the PIO's response is not satisfactory and that you are entitled to receive the information.
As per the R.K. Jain 2013 case, the PIO is required to provide the information or explain why it cannot be provided. You can cite this case in your appeal and argue that the PIO has not followed the provisions of the RTI Act.
You can also contact the State Information Commission or the Central Information Commission for guidance on how to proceed. As per §20 of the RTI Act, the Commission can impose penalties on the PIO for not providing the information.
