Can I get information about commercial confidence under RTI?

I want to get the information about a company that has been awarded a government contract. The company claims that the information is commercial confidence and cannot be disclosed. Can I file an RTI application to get this information? Will the PIO deny it citing section 8(1)(d) of the RTI Act?

Section 8(1)(d) of the RTI Act exempts information that is commercial confidence. The PIO will likely deny the information citing this exemption. However, you can try to get the information under section 10 of the RTI Act, which allows for severability of information.

The commercial confidence is not exempt under section 8(1)(d) if it's already publicly available. You can try to get the information if it's already publicly available.
