I filed an RTI application to obtain the beneficiary status of PMAY-U, but the PIO refused to provide the information. I want to file an appeal against the PIO's refusal, but I am not sure about the process. Can someone please guide me on how to file an appeal?

Know the practical answer?

You can file a first appeal with the Appellate Authority, citing §19(1) of the RTI Act. You will need to provide the details of your RTI application and the PIO's response, as well as the grounds for your appeal.

As per the Khanapuram Gandaiah 2010 case, the Appellate Authority is required to hear your appeal and provide a decision within a specified timeframe. You can cite this case in your appeal and argue that the Appellate Authority should hear your appeal and provide a decision.

You can also contact the State Information Commission or the Central Information Commission for guidance on how to proceed. As per §20 of the RTI Act, the Commission can impose penalties on the PIO for not providing the information.
