I filed an FIR in January at the local police station in Mumbai. The case number is 012/2023. How can I get the status of the investigation under the RTI Act? Should I apply under §6(1) and what details should I provide?

You can file an RTI application under §6(1) to the PIO of the police station, asking for the current status of the investigation. Provide your FIR number and date of filing.

The PIO might deny the information citing §8(1)(h), but you can argue that the investigation is complete, and the information can't be denied under this clause. Refer to the Bhagat Singh v CIC 2007 case.

You should also ask for the case diary under §10 of the RTI Act, which will give you the details of the investigation.

If the PIO denies the information, you can file an appeal under §19(1) to the Appellate Authority.
