I filed a second appeal with the CIC, and I want to know about the powers of the CIC under §19(8) of the RTI Act. What can the CIC do, and how can I use these powers to my advantage?

Know the practical answer?

The CIC has the power to direct the PIO to provide the information, impose penalties on the PIO, and recommend disciplinary action against the PIO. The CIC can also inspect the records of the public authority and take any other steps necessary to ensure that the information is provided.

The CIC's powers under §19(8) are subject to the provisions of the RTI Act, including §6(1), §7(1), and §8(1)(j). You should ensure that you are aware of these provisions and how they apply to your case.

In the case of Thalappalam (2013), the CIC held that the CIC's powers under §19(8) are wide enough to enable it to take all necessary steps to ensure that the information is provided. You may want to cite this case in your second appeal to argue that the PIO's decision was not in accordance with the RTI Act.
