3 repliesThe hearing process in a second appeal is an opportunity for you to present your case to the CIC. The CIC will ask you questions and consider the evidence provided by you and the PIO. You should be prepared to argue your case and provide additional evidence if required.
The CIC may also ask the PIO to provide additional information or evidence during the hearing. The CIC will consider all the evidence and make a decision on your appeal, as per §19(8) of the RTI Act. You should ensure that you are prepared to address any questions or concerns raised by the CIC.
In the case of R.K. Jain (2013), the CIC held that the hearing process should be fair and transparent. You may want to cite this case in your second appeal to argue that the PIO's decision was not in accordance with the RTI Act.
