I filed an RTI application to get a copy of my FIR, but the PIO refused, citing §8(1)(h). The FIR was filed 6 months ago. Can I appeal against this decision? What are my chances of getting the FIR copy?

Best solution

The PIO's decision to deny the FIR copy under §8(1)(h) might not be justified if the investigation is complete. You can cite the Bhagat Singh v CIC 2007 case in your appeal.

You should also ask for the reasons behind the PIO's decision and the current status of the investigation.

You can file an appeal under §19(1) against the PIO's decision. The Appellate Authority might overrule the PIO's decision if the investigation is complete.
