Evidence Required for Second Appeal

I filed an RTI application with the PIO of a government department to get information about the details of a project. The PIO replied, but the information was incomplete. I filed a first appeal, but the FAA did not provide a satisfactory order. Now, I want to file a second appeal with the CIC. What evidence do I need to provide to support my appeal?

You need to provide a copy of your original RTI application, the PIO's reply, the first appeal, and the FAA's order. You should also provide any additional evidence that supports your appeal, such as documents or witness statements. The CIC may also ask for additional evidence during the hearing process, as per §19(1) of the RTI Act.

The CIC will consider the evidence provided by you and the PIO to make a decision on your appeal. The CIC may also inspect the records of the public authority, as per §19(8) of the RTI Act. You should ensure that the evidence you provide is relevant and supports your arguments.

In the case of Jayantilal Mistry (2015), the CIC held that the appellant must provide sufficient evidence to support their appeal. You may want to cite this case in your second appeal to argue that the PIO's decision was not in accordance with the RTI Act.
