First appeal: PIO refused to provide information on hospital budget
I filed an RTI application asking for the budget of a government hospital, but the PIO refused to provide it, citing §8(1)(j) of the RTI Act 2005. I think this is not a valid reason. Can someone please help me draft a first appeal to the Appellate Authority?
Know the practical answer?

3 repliesYou can draft a first appeal under §19(1) of the RTI Act 2005, stating that the PIO's reason for refusal is not valid. You should also cite the Girish Deshpande 2013 case, which deals with the disclosure of financial information.
You should also ask for the PIO's reasoning behind the refusal, as per §7(1) of the RTI Act 2005, which deals with the disposal of requests.
The PIO's refusal is valid, as the budget of the hospital is not a public document, and §8(1)(j) of the RTI Act 2005 exempts its disclosure.
