On what grounds can my RTI be rejected?

An RTI can only be refused under the specific exemptions in Section 8 (such as national security, personal privacy, information held in fiduciary capacity, or matters before a court) and Section 9 (copyright held by someone other than the State).

Even then, the PIO must:

  • Name the exact clause being used
  • Give reasons for the refusal
  • Tell you the appellate authority and the deadline

A refusal that does none of this is unlawful and easily overturned on appeal.
